USE OF ISLAND BBQ (Walkin, Shopping), WEBSITE Or ORDERING SYSTEMS
These Terms & Conditions of Use govern your use of the Island BBQ Limited walk-in ordering, website and applications, including online and SMS ordering. References to 'website' include the following (as appropriate): https://www.islandbbq.co.nz or any other site, services (including web-services), software, application or media managed by Island BBQ Limited. Your use of the Island BBQ website constitutes your acceptance of these Terms & Conditions of Use.
Subject to law, Island BBQ may, in its discretion, from time to time amend or otherwise modify the Terms & Conditions of Use. Island BBQ recommends you carefully read, each time you visit the website, the Terms & Conditions of Use as they may affect your rights.
If you do not agree with the Terms & Conditions of Use, do not use the website or order online or via SMS.
PRIVACY
Island BBQ Limited respects the privacy of individuals. This policy sets out the way in which Island BBQ collect, hold, disclose, use and protect your personal information.
By visiting any of our websites (including by using an application on a smart device), creating any accounts, placing an order with any of our stores (including Licenced stores) or providing us with your personal information, you agree to your personal information being collected, held, used within the laws of New Zealand. Island BBQ discloses information to third parties (such as credit card agencies and banks) only as it relates to when you place an order online and the processing and handling of your order. This data is secure and anonymised for your protection.
ORDERING AND DELIVERY
1. When using any form of electronic payment including credit cards, the person ordering must be the owner of the said card or bank account, failure to do so will mean all rights and terms afforded to you may be (a) void. (b) Any Bank Chargebacks by the credit company or bank will be your entire responsibility including any collection fee or any costs incurred from said Chargeback
2 (a) From time-to-time items will run out, especially towards closing times of the shop, specials or high-demand items; should this occur Island BBQ will substitute items including sides, fries (style), salads, and deserts for products of equal or greater value, and where possible it is our policy to call (in the case or phone and online orders) to inform of said substitution
2 (b) When ordering online the wait time is set at 40 minutes, it maybe prepared early and sometimes during peak times can be longer, it is only an estimated time. We will txt you when your order is ready for pickup. You will need ID and or the credit card you paid for the order
3. Food Delivery may be operated by Third Party drivers (Including UBER EATS, Door-Dash, MENULOG or Independent Couriers). As independent agents, the responsibility to deliver and courier your order to your stated destination is entirely the responsibility of this agent. During peak times delivery within the 7 KM radius of each Store can take up to an Hour, should any significant delays occur we will call you to inform you of the progress
4. Ordering and self-pickup if entirely the responsibility of the person ordering and picking items/food from Island BBQ, including ensuring that your order is correct, and to your requirements, once the items/food has left the ISLAND BBQ premise no further responsibility, refunds or readdress will be considered
5. When weight is provided for food items, this is measured as a pre-cook weight. When cooked the final product could weigh up to 50% less. For catering we have provided the estimated amount the final cooked product will feed
INDEMNITY
You agree to defend, indemnify and hold harmless Island BBQ Limited and related corporations, affiliates, and the officers, directors, employees and agents of these entities, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to legal fees) arising from or in connection with: (i) your use of and access to the website (including any online ordering and applications); (ii) your violation of any term of these Terms & Conditions of Use; and (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; (iv) any claim that one of your User Submissions caused damage to a third party; and (v) use of the User Submissions by Island BBQ Limited.
ABILITY TO ACCEPT TERMS & CONDITIONS OF USE
You affirm that you are either more than 18 years of age, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms & Conditions of Use, and to abide by and comply with these Terms & Conditions of Use.
REFUNDS
As a general rule, Island BBQ Limited cannot refund meals or goods that have left the Store, it is the responsibility of the purchaser to check items before leaving. Online orders (excluding where items are substituted), and where Island BBQ has failed to provide the service and items we advertise, a Store credit may be applied at the Store Managers discretion.

CATERING TERMS AND CONDITIONS

Minimum order
Unless stated the minimum order for event catering is $350.00 or 20 people. Orders must be in writing via email to info@islandbbq.co.nz. An electronic quote will be sent to you and to confirm your catering and all terms and conditions below click accept. Once you accept the quote an invoice with our Payment details will be emailed to you.
Weight of BBQ’d Meat
Is based on pre-cook weight, and we have calculated what is a reasonable serve size for the estimated amount of people each tray may feed.
Deposit Required & Payment
20% deposit is required within 5 days of the booking being made otherwise it will be automatically cancelled, this will secure your quote and date for your event. Full Payment must be received 10 business days prior to the event. Credit Card Payments are subject to a 2.75% surcharge
Cancellations
If a cancellation is made within four weeks of the date of your function the deposit will not be refunded. If a cancellation is made before 5 working days of your function you are required to pay 75% of the final cost of the event, after that time we are not able to make any refund. Cancellation must be made in writing.
Changes to Orders
All changes to your order are to be made no later than 5 working days prior to the event date.
Delivery fee
We only deliver in the Auckland region and a flat fee of $60.00 is charged per delivery van, larger orders will be subject to multiple delivery fees as additional vehicles and staff will be required to transport your food to the site
Packaging & Hot Boxes and Cutlery
Bulk BBQ Meat is packed in aluminium trays, foiled and plastic wrapped for transport. We transport these in large hot boxes which can be purchased for $30 each (each box holds up to 4 large trays). Ready to Eat Meals are in thermo plates and packed wither into Hot boxes, these can be purchased for $30 (These will hold 12 plates per box) or Cardboard Boxes Each $10.95 (These will hold 12 plates per box).
Cutlery, napkins, condiments and serving spoons etc are not provided – however, these can be purchased should you require them.
